Participation in any puzzle, mini-game, challenge, side quest, leaderboard, or community activity on this site (collectively, “Activities”) does not guarantee that you will receive a gift, prize, payout, airdrop, access, or any other benefit. Outcomes depend on many factors (including luck, skill, timing, and adherence to the rules). No promise, warranty, or representation of any reward or outcome is made.

2) Voluntary Participation

All Activities are 100% voluntary. By participating, you confirm you are acting of your own free will and not in reliance on any promise of reward, employment, partnership, or future benefit.

You are solely responsible for ensuring participation is lawful where you live. If it isn’t, do not participate.

6) Integrity & Anti-Abuse (Site-Wide)

We may disqualify or ban anyone reasonably believed to be cheating, exploiting, creating multiple/fake accounts, harassing others, violating platform/site rules, or undermining fair play. We may pause, modify, or cancel any Activity to protect game integrity.

7) Technical Issues

We do not guarantee uninterrupted access. Activities may experience bugs, downtime, or changes. We may void or re-run parts of an Activity affected by technical issues at our sole discretion.

8) Gifts, Awards, and Selection (If Any Are Offered)

If a gift is offered for a specific Activity, the type, quantity, criteria, and timing will be described at or before the Activity begins. Substitutions may occur.

Potential recipients may need to complete basic verification and respond within a stated time; failure may result in forfeiture.

Taxes/compliance: You are responsible for any taxes or filings in your jurisdiction.

Personal Connection Disqualification (Primary Gift): Notwithstanding any other provision of these Rules, any individual who, on or before September 15, 2025, exchanged more than thirty-three (33) personal text messages (SMS, MMS, iMessage, or comparable direct-messaging communications of a personal, non-business nature, in either direction, in aggregate) with Chad Bird, Elizabeth Bird, or Jotham Bird, whether with one such person or with any combination of them, is permanently and irrevocably disqualified from claiming, receiving, or being awarded the primary gift associated with Trezor Quest (the hidden Trezor hardware wallet and any cryptocurrency or other contents thereof), regardless of puzzle-solving achievement, leaderboard standing, or apparent eligibility under any other provision. This disqualification exists to preserve the integrity of the hunt and to remove any appearance of preferential access, insider knowledge, or undue influence. The determination of whether the threshold has been met, and whether messages qualify as “personal” in nature, rests in the sole and absolute discretion of the Rights Holder, whose determination shall be final and non-appealable. Disqualified individuals remain free to participate in all other Activities, side quests, and community events for personal enjoyment, but shall not be eligible to claim the primary gift under any circumstance.

9) Safety & Real-World Conduct

If an Activity involves real-world exploration: obey all laws and posted signs, respect private property, and use common-sense safety. Never put yourself or others at risk.

10) Player Wellbeing, Immersion Boundaries, and Acknowledgment of Fictional Nature

Trezor Quest is a work of interactive fictional entertainment incorporating puzzles, narrative lore, characters, simulated communications, fictional operatives, mock-historical references, ciphers, audiovisual content, and other creative elements designed solely for amusement and intellectual challenge. All storylines, factions, organizations, missives, transmissions, prophecies, riddles, alleged artifacts, and related game content are entirely fictional. Any resemblance to actual persons, entities, agencies, events, or communications is either coincidental or used in a fictionalized, satirical, or transformative capacity.

By participating in any Activity, you expressly acknowledge, represent, and agree that:

(a) You are capable of and solely responsible for distinguishing the fictional content of Trezor Quest from objective reality, and you covenant to maintain such distinction at all times during and after participation;

(b) You will not construe, interpret, or treat any puzzle, clue, in-game communication, character dialogue, lore document, audiovisual content, code, cipher, or other game element as a personal directive, prophetic instruction, supernatural message, governmental communication, intelligence-agency contact, religious revelation, or message of any kind directed at you personally outside the explicit context of voluntary, opt-in gameplay;

(c) You will not act upon any in-game content in any manner that endangers your physical safety, mental health, financial wellbeing, relationships, employment, legal standing, or the safety of any other person;

(d) If you begin to experience derealization, depersonalization, paranoid ideation, obsessive or intrusive thinking, sleep disturbance, escalating fixation, magical thinking, apparent receipt of personal messages through game content, or any condition in which the boundary between fictional game content and lived reality becomes blurred, uncertain, or distressing, you agree to immediately cease all participation, disengage from the site and associated communities, and seek the assistance of a licensed mental health professional, primary care physician, or other qualified provider in your jurisdiction;

(e) Chad Bird, Trezor Quest, and all of their respective family members, heirs, affiliates, business entities, partners, contractors, agents, and employees (together with the parties identified in the indemnity provision below, collectively the “Indemnified Parties”) are not licensed mental health providers, are not qualified to diagnose, assess, or treat any condition, and disclaim any therapeutic, counseling, clinical, spiritual, or advisory role of any kind. Nothing on this site, in the lore, in any communication from any operative, or in any community channel constitutes medical, psychiatric, psychological, therapeutic, religious, or financial advice;

(f) You assume sole and exclusive responsibility for monitoring your own mental, emotional, and psychological state before, during, and after participation, and you agree to discontinue participation if a trusted person in your life, a medical or mental health provider, or your own reasonable judgment indicates that continued participation is not in your best interest;

(g) If you are currently receiving treatment for, or have a personal or family history of, any condition that may be exacerbated by puzzle-driven, narrative-driven, or alternate-reality-style entertainment (including without limitation psychotic spectrum disorders, dissociative disorders, obsessive-compulsive disorder, severe anxiety disorders, post-traumatic stress disorder, or active substance use disorders), you should consult your treating provider before participating, and you do so at your own risk;

(h) The Indemnified Parties shall bear no responsibility, liability, or duty of care of any kind for any psychological, emotional, behavioral, cognitive, relational, occupational, financial, or spiritual consequence arising from or related to your engagement with the site, the lore, the community, the operatives, or any other Trezor Quest content, regardless of how such consequence manifests, when it manifests, or how it is characterized;

(i) The protections, disclaimers, and limitations set forth in this Section apply with full force regardless of whether the Indemnified Parties knew or should have known of any particular vulnerability of the participant, and your continued participation constitutes ongoing reaffirmation of this acknowledgment.

If you or someone you know is experiencing a mental health crisis, please contact a local emergency service, a licensed provider, or an established crisis support line in your jurisdiction. Trezor Quest is not equipped to respond to crisis communications and is not a substitute for professional support of any kind.

11) Intellectual Property

All site content (puzzles, text, images, code, audio, video) is protected. You receive a personal, non-transferable license to access and play as permitted. Don’t copy, rehost, decompile, or distribute without permission.

12) Fictional Operatives, NPCs, and Character Intellectual Property

All non-player characters, operatives, agents, handlers, informants, adversaries, factions, organizations, personas, code names, call signs, mascots, alter egos, voiced entities, written entities, and any other character-based creations appearing in, referenced by, or associated with Trezor Quest (collectively, the “Operatives”) are original, fictional creative works of authorship.

Each Operative, including without limitation the Operative’s name, code name, alias, handle, visual depiction, voice, dialogue, biographical details, backstory, mannerisms, signature phrases, catchphrases, equipment, costuming, in-world rank, in-world affiliation, distinctive personality traits, and any associated logos, sigils, insignia, color palettes, typography, or other identifying features, constitutes copyrightable expression and, where applicable, protected trademark, trade dress, and rights of publicity owned exclusively by Chad Bird and his designated business entities (collectively, the “Rights Holder”).

The Operatives exist solely and exclusively for the purpose of providing entertainment within the official Trezor Quest experience as published, displayed, and performed by the Rights Holder. No license, express or implied, by estoppel, by exhaustion, by course of dealing, or otherwise, is granted to any participant, viewer, reader, listener, community member, fan, content creator, or third party of any kind to:

(a) Reproduce, copy, perform, broadcast, stream, livestream, podcast, or publicly display any Operative, or any character substantially similar to any Operative, in any medium now known or hereafter devised;

(b) Create derivative works, sequels, prequels, fan fiction (whether commercial or non-commercial), spinoffs, crossovers, alternate-universe interpretations, parodies (other than as expressly protected by applicable law), or any other works incorporating, depicting, or substantially based upon any Operative;

(c) Manufacture, sell, offer for sale, distribute, license, or otherwise commercialize any merchandise, apparel, collectible, figurine, sticker, print, poster, NFT, digital asset, token, trading card, plush, prop replica, or other tangible or intangible good depicting, referencing, naming, or substantially imitating any Operative;

(d) Impersonate, portray, cosplay for commercial purposes, voice, dub, narrate, or otherwise embody any Operative for the purpose of generating revenue, soliciting donations or tips, building audience, monetizing content, sponsoring products, or competing with the Rights Holder;

(e) Use any Operative, or any character substantially similar to any Operative, to endorse, promote, advertise, or solicit interest in any product, service, organization, political position, religious position, ideology, fundraising effort, or third-party offering of any kind;

(f) Train, fine-tune, condition, or otherwise use any Operative-related content as input, training data, reference material, or seed material for any machine learning model, generative artificial intelligence system, voice cloning system, image synthesis system, deepfake system, or other automated or semi-automated content generation technology, whether for commercial or non-commercial purposes, and whether public or private;

(g) Register, claim, file, or otherwise assert ownership of, or rights in, any Operative name, likeness, trademark, service mark, social media handle, username, domain name, or other identifier corresponding to or confusingly similar to any Operative;

(h) Create new characters that are confusingly similar to, derivative of, or substantially based upon any Operative, including through paraphrasing of distinctive backstory, replication of distinctive visual elements, adoption of substantially similar names or aliases, or recreation of distinctive personality patterns; or

(i) Authorize, encourage, induce, or assist any third party to engage in any of the foregoing prohibited acts.

Limited Personal Fan Engagement: Solely as an accommodation, and not as a grant of any right or license, the Rights Holder may in its sole and absolute discretion tolerate limited, non-commercial, personal-use fan engagement (such as good-faith community discussion of Operatives, sharing of original analysis of in-game content, or posting of reaction content incorporating de minimis references). Any such tolerance is revocable at any time, for any reason or for no reason, without notice and without liability. Tolerance does not constitute a license, waiver, estoppel, or course of dealing, and shall not be construed as authorization for any other use.

The Rights Holder reserves all rights not expressly granted herein, including without limitation the right to issue takedown notices under the Digital Millennium Copyright Act and analogous foreign legislation, the right to assert claims for copyright infringement, trademark infringement, trade dress infringement, unfair competition, false endorsement, dilution, passing off, violation of rights of publicity and personality, and any other available cause of action, and the right to seek injunctive relief, statutory damages, actual damages, disgorgement of profits, costs, and attorneys’ fees to the maximum extent permitted by applicable law.

Any unauthorized use of an Operative, or any substantially similar character, shall be deemed willful and intentional infringement for all purposes, including without limitation calculation of statutory damages and assessment of equitable remedies. By participating in any Activity, you affirmatively acknowledge that you have read, understood, and agreed to be bound by the restrictions set forth in this Section, and you agree that the Rights Holder shall be entitled to immediate equitable relief, without the necessity of posting bond, in the event of any actual or threatened breach.

13) Disclaimers & Limitation of Liability

Activities are provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, we and our partners are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost opportunities or expectations of gifts/rewards. If liability is found, our aggregate liability for any claim related to the Activities is limited to USD $50 (or the minimum amount permitted by law).

14) Indemnity

You agree to indemnify, defend, and hold harmless Chad Bird, his family members, heirs, associates, affiliates, business entities, partners, contractors, agents, employees, and any other persons or entities associated with Trezor Quest or Chad Bird (collectively, the “Indemnified Parties”), from and against any and all claims, demands, actions, damages, liabilities, costs, losses, and expenses (including reasonable attorneys’ fees and court costs) arising from or related to:

(a) Your participation in any Activities, including the treasure hunt known as Trezor Quest;

(b) Your breach of these Rules or any applicable law;

(c) Your content, submissions, or conduct;

(d) Any injury, loss, or damage to person or property caused by your participation;

(e) Any contact, communication, or interaction you initiate with Chad Bird, his family, or any associated parties outside of official Trezor Quest Activities;

(f) Any trespass, property damage, or violation of law committed by you in connection with Trezor Quest;

(g) Your violation of any third-party rights, including intellectual property rights or privacy rights.

This indemnification obligation survives termination of your participation and these Rules. You acknowledge that Chad Bird’s family members have no involvement in, knowledge of, or responsibility for any aspect of Trezor Quest Activities, including treasure placement or puzzle design, and must not be contacted or approached regarding Trezor Quest.

15) Changes, Suspension, Termination

We may update these Rules or any Activity, or suspend/terminate access, at any time. Material changes will be reflected on this page with a revised “last updated” date.

Retroactive Effective Date: All Rules, terms, conditions, disclaimers, restrictions, eligibility criteria, disqualification provisions, and other provisions set forth in this document, together with any amendment, modification, addition, revision, supplement, restatement, or replacement thereof adopted, drafted, posted, or otherwise made effective at any time after September 15, 2025, shall be deemed to have taken effect as of September 15, 2025 (the “Effective Date”), and shall apply retroactively in full force and effect to all Activities, participation, conduct, communications, submissions, claims, and interactions occurring on or after the Effective Date, irrespective of when such Rules, terms, conditions, or amendments were drafted, finalized, posted, or made publicly available. Each participant, by continuing to access the site or participate in any Activity following the adoption of any such amendment, expressly accepts, ratifies, and reaffirms the Rules as so amended with retroactive effect to the Effective Date, and irrevocably waives any objection or defense based upon lack of notice, lack of contemporaneous publication, absence of the amended language at the time of any prior participation, reliance upon a prior version of the Rules, or any similar theory. This retroactive-effect provision is a material term of these Rules and is intended to be enforced to the fullest extent permitted by applicable law; if any application of this provision is held unenforceable in a particular instance, the remainder of this provision and these Rules shall continue in full force.

16) Governing Law & Dispute Resolution

These Rules are governed by the laws of our principal place of business (without regard to conflict-of-law rules). Disputes shall be brought in the forum specified in our Terms of Use (if any).

17) Severability

If any portion of these Rules is found unenforceable, the remainder remains in effect.

18) Entire Agreement

These Rules, plus any Activity-specific instructions, our Terms of Use, and our Privacy Policy, are the entire agreement regarding Activities on this site.

Information We Collect: We may collect information you voluntarily provide (email addresses for notifications, usernames, wallet addresses for prize distribution), technical data (IP addresses, browser type, device information, operating system), and gameplay data (progress, scores, timestamps, cookie/local storage data, session information).

How We Use Information: Information is used to operate and improve Activities, communicate about prizes or updates, prevent fraud and abuse, maintain game integrity, comply with legal obligations, analyze usage patterns, and respond to user inquiries.

Information Sharing: We do not sell personal information. We may share information with service providers (hosting, email, analytics) under confidentiality agreements, legal authorities when required by law or to protect rights and safety, prize fulfillment partners (only information necessary for delivery), and business transferees in the event of merger, acquisition, or asset sale. Gameplay data may be retained indefinitely for integrity and historical purposes. You may request deletion of your personal information by contacting us, though we may retain certain information as required by law or for legitimate business purposes.

Third-Party Services: Our site may use third-party services (analytics platforms, content delivery networks, payment processors, hosting providers, APIs) that have their own privacy policies. These services may collect information independently. We are not responsible for third-party practices and encourage you to review their policies.

Cookies & Tracking: As described in our Cookie Policy, we use cookies and local storage for essential gameplay functionality, session management, and user preferences. These technologies enable features like saving progress, remembering settings, and preventing cheating. You can disable cookies in your browser settings, but doing so may impair or prevent gameplay functionality.

Children’s Privacy: Activities are not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. International Users: If you access Trezor Quest from outside the United States, you acknowledge that your information may be transferred to, stored in, and processed in the United States or other countries where our service providers operate. These jurisdictions may have different data protection standards than your home country. By using our site, you consent to such transfers.

Your Rights: Depending on your location, you may have rights under applicable privacy laws to: access personal information we hold about you, correct inaccurate information, request deletion of your information (subject to legal retention requirements), restrict or object to certain processing, request data portability, and withdraw consent where processing is based on consent. Do Not Track: Our site does not currently respond to “Do Not Track” browser signals, as there is no industry standard for compliance.

Changes to Privacy Policy: We may update this Privacy Policy at any time to reflect changes in practices, technology, legal requirements, or other factors.
